These Terms of Service ("Terms") govern your use of MDBadgePilot, a Shopify application published by FORTY & FREE (IDOW), a French SARL (SIREN: 925 005 753), headquartered at 48 Allée de Baceda, 59830 Bachy, France.
1. Acceptance of terms
By installing and using MDBadgePilot, you agree to be bound by these Terms. If you do not agree to these Terms, do not install or use the application.
2. Description of service
MDBadgePilot is a Shopify application that shows badges on product images and product cards of your online store, on products you choose or on products matching conditions you configure. The service is offered in two plans: a Free plan with limited features and a Pro plan ($7.99/month or $79.90/year) with unlimited badges.
3. Account and access
MDBadgePilot is accessed through your Shopify admin. You are responsible for the security of your Shopify account. We rely on Shopify's authentication system and do not manage separate user accounts.
4. Free and Pro plans
The Free plan includes 1 active badge, manual or automatic with 1 condition (on sale, stock, sold out or days since creation), evaluated when products change and once a day. The Pro plan ($7.99/month or $79.90/year, with a 7-day free trial) includes unlimited badges, up to 10 conditions per badge with AND/OR logic, conditions on discount, sales, price, tag, type, vendor and product metafields, hourly evaluation and scheduling by dates. Billing for the Pro plan is handled by Shopify's billing system.
5. Cancellation and refunds
You may cancel your Pro subscription at any time by switching back to the Free plan or by uninstalling MDBadgePilot. When you switch back to the Free plan, only your oldest badge stays active. Refunds are handled according to Shopify's billing policies.
6. Data and privacy
Your use of MDBadgePilot is also governed by our Privacy Policy. We only access the Shopify data needed to show your badges. We do not access your customers' personal data.
7. Your theme
MDBadgePilot displays badges through a theme app extension that you turn on and off in your theme editor. It does not modify your theme files. Display depends on your theme: we test Online Store 2.0 themes but cannot guarantee that badges show the same way on every theme.
8. Limitation of liability
MDBadgePilot is provided "as is" without warranties of any kind. FORTY & FREE shall not be liable for any indirect, incidental or consequential damages arising from the use or inability to use the service. You are responsible for the texts of your badges and for the conditions you configure, including any claim a badge makes about prices, discounts or stock.
9. Modifications to the service
We reserve the right to modify, suspend or discontinue MDBadgePilot at any time, with or without notice. We may also update these Terms. Continued use of the application after changes constitutes acceptance of the new Terms.
10. Intellectual property
MDBadgePilot, including its code, design and content, is the property of FORTY & FREE. You are granted a non-exclusive, non-transferable license to use the application in connection with your Shopify store.
11. Governing law
These Terms are governed by the laws of France. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Lille, France.
